General Terms and Conditions

General Terms and Conditions as of: October 14, 2026

§ 1 Scope and Definitions

(1) distinctions GmbH, Gustav-Freytag-Straße 6, 65189 Wiesbaden, Germany (hereinafter “we,” “us,” or “Myself at Work”) operates an online store at myselfatwork.com for goods, digital goods, and services. These General Terms and Conditions apply to all products and services provided by us to our customers (hereinafter “Customer” or “you”) in the version in effect at the time the order is placed, unless expressly agreed otherwise.

(2) A “Consumer” within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for purposes that are predominantly outside that person’s trade, business, or profession. A “Trader” is a natural or legal person or a partnership with legal personality that, when entering into a legal transaction, acts in the exercise of its trade, business, or profession. A partnership with legal personality is a partnership that has the capacity to acquire rights and enter into obligations.

§ 2 Contract Formation and Storage of the Contract Text

(1) The following provisions on contract formation apply to orders placed through our online store at myselfatwork.com.

(2) Our online product presentations are non-binding and do not constitute a binding offer to enter into a contract.

(3) When an order is received through our online store, the following provisions apply: The Customer submits a binding offer to enter into a contract by successfully completing the ordering process provided in our online store. The order is placed in the following steps:

  1. Selecting the desired goods, digital goods, and selected service(s),
  2. Adding the products by clicking the relevant button (e.g., “Add to Cart,” “Add to Bag,” or similar),
  3. Reviewing the information in the shopping cart,
  4. Opening the order summary by clicking the relevant button (e.g., “Proceed to Checkout,” “Continue to Payment,” “Review Order,” or similar),
  5. Entering/reviewing the address and contact details, selecting the payment method, Acknowledgement of the General Terms and Conditions and Withdrawal Instructions.
  6. Completing the order by clicking the “Buy Now” button. This constitutes your binding order.
  7. The contract is concluded when you receive an order confirmation from us at the email address provided within three working days.

(4) If a contract is concluded, it is concluded with distinctions GmbH, Gustav-Freytag-Straße 6, 65189 Wiesbaden, Germany.

(5) Before placing the order, the contract data can be printed using the browser’s print function or saved electronically. The order is processed and all information required in connection with the conclusion of the contract, in particular the order details, the Terms and Conditions, and the Withdrawal Instructions, is transmitted by email after you submit the order, in part through automated processes. We store the contract text after the contract has been concluded. If you created a customer account, you can also view your orders there.

(6) Input errors can be corrected using the usual keyboard, mouse, and browser functions (e.g., the browser’s “Back” button). They can also be corrected by ending the ordering process before completion, closing the browser window, and repeating the process.

(7) The order is processed and all information required in connection with the conclusion of the contract is transmitted by email, in part through automated processes. You must therefore ensure that the email address you have provided to us is correct, that receipt of the emails is technically possible, and, in particular, that the emails are not blocked by spam filters.

§ 3 Subject Matter of the Contract and Essential Features of the Products

(1) The subject matter of contracts entered into through our online store includes:

  1. The sale of goods. The specific goods offered are shown on our product pages.
  2. The sale of digital goods, such as software or media downloads. The specific digital goods offered are shown on our product pages.
  3. The provision of services. The specific services offered are shown on our product pages.

(2) If a contract for goods with digital elements or for digital products (digital content and services) is concluded with a Consumer and the statutory obligation to provide updates is not effectively excluded by contract, updates required to maintain functionality and the necessary security updates also form part of the contract.

(3) The essential features of the goods, digital goods, and services are set out in the product description. If the agreed characteristics of the goods deviate from their usual characteristics and conditions of use, this is expressly stated in the product description (agreement on a deviation from the objective conformity requirements). To the extent that the Customer has expressly consented to the deviation, that agreement defines the subject matter of the contract.

(4) The sale of digital products is subject to the restrictions stated in the product description or otherwise arising from the circumstances, particularly hardware and/or software requirements for the target environment. Unless expressly agreed otherwise, the contract covers only the personal and business use of the products, without the right to resell or sublicense them.

§ 4 Prices, Shipping Costs, and Delivery

(1) The prices and shipping costs stated in the respective offers are total prices and include all price components, including all applicable taxes.

(2) The applicable purchase price must be paid before the product is delivered (advance payment), unless we expressly offer payment by invoice. The payment methods available to you are shown under an appropriately labeled button in the online store or in the relevant offer. Unless otherwise stated for a particular payment method, all amounts payable are due immediately.

(3) Shipping costs may be charged in addition to the stated prices for the delivery of products unless the relevant item is identified as including free shipping. The shipping costs will be clearly communicated to you again in the offers, where applicable in the shopping cart system, and in the order summary.

(4) Unless clearly stated otherwise in the product description, all products offered are ready for shipment immediately (delivery time: 2–5 working days after receipt of payment).

(5) We conclude contracts only with customers whose place of residence or registered office is in a Member State of the European Union. We reserve the right to verify this information during the ordering process.

(6) We provide digital products, such as licence codes for the Myself at Work questionnaire, by email. We deliver goods only to delivery addresses in Germany and Austria.

(7) Notwithstanding paragraph 5, customers may attend our in-person events regardless of their place of residence or registered office.

§ 5 Events

(1) Registrations are binding. The contract for participation in an event is concluded only when the Customer receives the registration or order confirmation. In the event of overbooking, the person registering will be informed without undue delay; no contract is concluded in that case.

(2) Free cancellation is only possible within the scope of the statutory right of withdrawal for consumers. Free cancellation is not available to business customers Unless otherwise provided, the Participant may transfer their participation to another person or select a different date up to the seventh day before the scheduled event. The requested change should be submitted in writing by email to support@myselfatwork.com. We reserve the right to charge a rebooking fee amounting to 50 EUR.

(3) We reserve the right to cancel an event for organizational reasons (e.g., if the minimum number of participants is not reached) up to the fifth day before the scheduled event and, for good cause beyond distinctions’ control (e.g., illness or accident of the speaker) or due to force majeure, up to and including the scheduled event date. If we cancel an event and payment has already been received, the full amount paid will be refunded. Any further claims, in particular for reimbursement of travel and accommodation costs, shall exist only in accordance with Section 9 (Liability). If we cancel an event date to which the Customer has already rebooked, the Customer may rebook again, free of charge, for another event date or another Myself at Work event.

(4) We reserve the right, for good cause (e.g., illness), to use a different, equally qualified speaker on the scheduled event date, notwithstanding the event program.

(5) Travel and accommodations are not included in the price and must be arranged by the Participant.

(6) Any written materials accompanying the events are protected by copyright held by distinctions GmbH and may not be reproduced or distributed without our consent. In particular, without limitation, materials, presentations, scripts, videos, images, audio recordings, etc. may not be passed on to third parties, publicly distributed, or made available to the public without our written consent. This also applies to excerpts from the accompanying materials.

(7) Unless otherwise stated, the price includes participation in the event and any materials provided.

§ 6 Right of Retention and Retention of Title

(1) You may exercise a right of retention only if and to the extent that it is based on claims arising from the same contractual relationship.

(2) The goods remain our property until the purchase price has been paid in full.

§ 7 Right of Withdrawal

As a Consumer, you have a right of withdrawal. This right is governed by our Withdrawal Instructions.

§ 8 Contract Language

The English version of these General Terms and Conditions is for information only. The German version prevails.

§ 9 Liability

(1) We are liable without limitation for intent and gross negligence, for damage arising from injury to life, body or health, under the German Product Liability Act, and to the extent of any guarantee we have given.

(2) In the event of a slightly negligent breach of a material contractual obligation, as well as in the event of delay or impossibility caused by slight negligence, our liability for resulting property damage and financial loss is limited to the foreseeable damage typical for this type of contract. A material contractual obligation is one whose fulfilment makes the proper performance of the contract possible in the first place, whose breach jeopardises the purpose of the contract, and on whose fulfilment you
may regularly rely. This includes in particular our obligation to provide the contractual services described in Section 3.

§ 10 Statutory Warranty Rights

(1) Statutory warranty rights are governed by the applicable statutory provisions.

(2) For Traders, the limitation period for statutory warranty claims relating to delivered goods is 12 months.

(3) As a Consumer, you are requested to inspect the goods, digital goods, or service provided promptly upon performance for completeness, obvious defects, and damage in transit and to notify us and the carrier of any complaints as soon as possible. Failure to do so will, of course, have no effect on your statutory warranty rights.

§ 11 Final Provisions / Dispute Resolution

(1) German law applies. For Consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence (principle of favorability).

(2) The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

(3) If the Customer is a merchant, a legal person under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the Customer and the Provider is the Provider’s registered office.

(4) The Customer may not assign, in whole or in part, any rights or obligations under these Terms and Conditions and the customer agreement without our prior written consent. Section 354a of the German Commercial Code (HGB) remains unaffected.

(5) If any provision of these Terms and Conditions is or becomes invalid, unenforceable, or incomplete, this does not affect the validity of the remaining provisions. The applicable statutory provisions shall apply in place of the invalid, unenforceable, or missing provision.

(6) We are neither required nor willing to participate in dispute resolution proceedings before a consumer conciliation body.
